This service is only available in relation to debts below £5000.00. We will draft and prepare the Claim Form on your behalf and issue it in the appropriate court. The court will serve the Debtor with the Claim. If a Defence is not entered by the Debtor, we will obtain default Judgment on your behalf. The cost of issuing claim can be recovered in most instances in addition to the debt (the court fee is dependent on the value of the claim).
The debtor must be employed in order to obtain such an Order. If you do not know where the debtor works, please order our employment status report in order to obtain details of the debtor’s employment status/details of employment. Once these details are obtained, and if such an Order would be appropriate, we can then apply to the Judge for an Order whereby the debtor’s employer pays the debt directly from their earnings.
If you know that the debtor owns a property and you have obtained a money Judgment against them, we can apply to obtain a Charging Order which we then register against the debtor’s property. If you do not know if the debtor owns a property, please use our homeowner discovery report first. Our fixed fee includes all solicitor’s costs, court fees and an advocate to attend court. The cost of this application can be added to the debt.
If you have obtained a Judgment which the debtor has failed to pay, we can apply to the court and arrange for the court bailiff or High Court Enforcement Officer where appropriate to go to the debtor’s address and seize the debtor’s goods. The fixed fee includes solicitors fees and court costs. The cost of the Warrant can be added to the debt.
A Statutory Demand has to be served before a Bankruptcy Petition can be issued against an individual. If can also be served against a company that owes you money. Statutory Demands should only be used where there is no dispute or where you have already obtained a Judgment. The fixed fee includes solicitor’s fee and process server’s fees.
In the case of Bankruptcy Proceedings, these can only be served once the Statutory demand has been served but the debtor has failed to pay/respond within the time limit. We will prepare the proceedings and issue them in the appropriate court. The proceedings must be personally served on the debtor whether it is a company or an individual, once the court has issued the proceedings. We will arrange for a process server to serve the proceedings within 48hrs. The above fee does not include court fees and process server’s fees.
All trace investigations will be conducted in accordance with all relevant UK and European legislation for debt collection.
Where our trace investigations prove to be unsuccessful you will be provided with a full account of our findings. All tracing will be completed within a maximum of thirty days from receipt and all positive traces are offered with a trace recheck service for your peace of mind..
Want to secure a monthly repayment via attachment of earnings but dont know where a debtor works then this is the report for you.
This report includes current employment status of the debtor, which would include the name and address of the employer for the debtor (if employed) and an approximate annual salary, if available. This report is useful if you are thinking of enforcing a CCJ with an attachement of earnings order.
Want to find out if a debtor has a major asset in the form of property ownership so you can secure your debt via a charging order.
Then this report is the one for you, it includes homeowner details, charges against property and an estimate of the value. The report will also include land registry details.
